This legislation will enhance the safety of all Massachusetts residents by allowing our law enforcement agencies greater flexibility when dealing with drivers whose abilities have been impaired by recent drug use. Under current Massachusetts statute, any licensed driver is required to submit to tests that would determine if the driver is under the influence of alcohol. The driver can be punished both for refusing to take the test, as well as failing the test itself. This is an important tool for law enforcement officers to get dangerous drivers off the road as quickly as possible, but there exists no such laws for driving under the influence of drugs. This bill would amend existing statute to apply the standards for driving under the influence of alcohol to those driving under the influence of different substances.
